The image must either be taken with a Leica Camera Product, i.e. a Leica Camera, a smartphone with Leica Camera module or a Leica Camera lens, or depict Leica Camera products (including Leica Sport Optics, Leica Eyecare and Leica Accessories products).

You must

• be the owner of all rights in the content (including, without limitation, the image, Instagram handle, captions, and comments) that you provide to us (“Content”) or have the consent of the person who owns the rights to the Content.
  
• obtain the express consent of all persons appearing in the Content to confirm that the images and names may be used by us in accordance with the terms of the license. If the persons depicted or mentioned are minors, you must obtain the express consent of their parents or legal guardians for the images and/or names to be used by us. Please inform them of these license terms before obtaining consent.

License Terms

1. Licensee
   The licensee is Leica Camera AG, Am Leitz-Park 5, 35578 Wetzlar, Germany.

2. Granting of rights
   By responding #yesleicaclassic to our request or otherwise consenting to our use of the Content (e.g., by direct messaging @leica_camera_classic), you are granting to us the free, non-exclusive, irrevocable right, unrestricted in time, space and content, to comprehensively use and exploit the Content within the scope of social networks, social media channels, websites, PoS advertising, trade fairs, exhibitions, sales events, competitions or other advertising or promotional purposes, also with the aim of commercial marketing.
   
   The granting of rights expressly includes all known and unknown forms of offering possibilities on the Internet, in particular the possibility of integration within freely accessible and paid online services and websites as well as in applications or other services, including those provided for mobile devices.
   
   However, the licensee is not entitled to allow users of the website to permanently store the works (download).
   
   In particular, you grant the following free, non-exclusive, irrevocable, temporally and territorially unrestricted rights of use:
   • the right to reproduce, make publicly available and distribute, i.e. the right to reproduce and make publicly available or publicly reproduce the Content, including by any technical means, in particular by digital inclusion within social networks, social media channels and websites, as well as in applications or other services, including those provided for mobile devices, without limitation;
   • the right of making available on demand, i.e. the right to store the Content, to make it available to the public, to transmit it to one or more persons requesting it, in all analog or digital electronic databases, electronic data networks and networks of telecommunication services;
   • the right of communication to the public, i.e. the right to reproduce the Content commercially or non-commercially, by sound carriers, image carriers, multimedia carriers or other data carriers, in particular also image discs (e.g. DVD, Blu-ray Disc), chips, in all formats, using all analog and digital processes and techniques;
   • the right to edit, i.e. the right to reshape and edit the Content as desired, while respecting the moral rights of the author, either by ourselves or through third parties, in particular for the purpose of integrating it into social networks, social media channels and websites;
   • the right to advertise, i.e. the right to use the Content for the promotion of social media channels and websites, also in any other media and outside the Internet, namely on television and in print media, but not for the promotion of third-party products.
   Further, the granting of rights includes
   • a partial use of the Content and a use in connection with other content;
   • the right, to use the respective title of the works and the names, titles, logos and images of both you and the author of the Content on social media channels and websites and in relevant advertising for social media channels and websites;
   • the right to grant sublicenses to our affiliated companies within the Leica Camera Group and to have contracted service providers perform tasks in connection with the above-mentioned uses.
3. Representations, liability, warranty
   
   • You represent that
     
     • you are of legal age;
     • the images you provide were taken with a Leica Camera product, i.e., a Leica Camera, a smartphone with a Leica Camera module, or a Leica Camera lens, unless Leica Camera products are depicted in the images;
     • that the content is free of any third-party rights that might conflict with the granting of rights under this agreement;
     • you represent that the Content has already been published and that the author will not take action against publication;
     • the use of the Content within the scope of this agreement does not violate the personal rights of third parties, in particular, that the persons depicted agree to the use of the Content as specified in this agreement and that you have the express consent of these persons and can prove this. If the persons depicted or mentioned are minors, you also represent that you have the express consent of their parents or legal guardians to use the Content in accordance with this agreement.
   • You shall indemnify us upon first request against all claims of third parties, in particular claims for infringement of copyright and personal rights, which may be asserted against us in connection with the exercise of the contractual rights. You shall notify us without delay of any infringements of the contractual rights of which you become aware. We are entitled to take suitable measures ourselves to defend ourselves against claims by third parties. The indemnification shall also include the reimbursement of the costs that we incur or have incurred as a result of legal prosecution/defense.
   • The indemnification referred to in paragraph 2 shall not apply if the third party's claim results from our use of the Content in violation of the provisions set forth in this agreement, in particular in violation of the license referred to in paragraph 2.
4. Complaints
   If you disagree with our use of the Content, or if you believe that we are using the Content without your consent or in violation of your rights, please contact us at social.classic.at@leica-camera.com so that we can resolve the problem.
5. Data Protection

6. Applicable law
   The law of Austria shall apply. Legal provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which you as a consumer have your habitual residence, shall remain unaffected by the aforementioned provisions.
